| 1. Definition |
| Exclusive Estates Marbella SL is acting for each individual property owner and which is empowered to enter into a contract on behalf of the owner with the client, who is the person in whose name the booking is made. The client’s contract is with the property owner. |
| 2. Your Holiday Contract |
| The party leader must be at least 21 years of age, and authorized by all other members of the party to book on their behalf. All correspondence and documents will be sent to the party leader, who is responsible for making all payments in respect of the booking, and also for ensuring that all members of their party are kept informed of details affecting their arrangements. |

| On receipt of the signed booking form and the reservation deposit (please see clause 3), we will send written confirmation of your holiday arrangements to you by email, fax or post. Accommodations are reserved only for the use of persons named on the booking form, so please check the booking confirmation. Please contact us immediately if any details are incorrect. |

| A contract between you, as the party leader, and us, will come into existence when you have paid a deposit and we have accepted your booking by issuing you with a booking number and our written confirmation. Telephone quotes are all provided subject to written confirmation. |
| 3. Terms of Payment of your Accommodation |
Deposit When you sign the booking form, you are agreeing to abide by these conditions, and you are required to pay 25% of the total charge as a reservation deposit to Exclusive Estates Marbella SL. This amount is non-refundable. |

| The rest of the payment is due in cash on arrival day. |
| Please note that the booking will not be confirmed until Exclusive Marbella has received the pre-payment amount and you have received a confirmation email from Exclusive Marbella. |
| 4. Occupation of your Accommodation |
| The accommodation will be available for you from 4 o’clock pm (16:00) on the day of your arrival. However, we will make every effort to have your accommodation ready for you earlier if necessary. All accommodation must be vacated by 10 o’clock am (10:00) on the day of departure, unless you have made prior arrangements with a member of staff to stay later. |
| 5. If you Alter your Booking |
| Once the booking is confirmed, if you wish to change the number of passengers in your party, or to alter any arrangements relating to accommodation, car hire or any other arrangements made by Exclusive Estates Marbella SL, we reserve the right to charge an administration fee of 20 Euros. This does not apply to alterations caused by published changes to flight times. |
| 6. If you Cancel your Booking |
| The person who signs the booking form must make any cancellations in writing, either by email, fax or post. Cancellation of accommodation will apply from the date of receipt by Exclusive Estates Marbella SL of the written cancellation advice. If the accommodation is cancelled more than 4 weeks before your arrival date, it will result in a loss of the deposit. However, if the cancellation is within 4 weeks of your arrival date, cancellation charges will apply. | 7. If we Change or Cancel your Booking |
| We reserve the right to make changes to holidays and website details, both before and after your booking is confirmed. As we plan these arrangements many months in advance, sometimes the accommodation which we have available may change, and this may affect your holiday. In the event that we have to change your booking and are unable to provide you with an alternative of an equal standard and location, we will refund any money paid to us in full, and shall be under no further liability. |
| 8. Cancellation by the Owner |
| In the very unlikely event that the accommodation you have booked ceases to be available, and Exclusive Estates Marbella SL are unable to offer a suitable alternative on behalf of the owner, Exclusive Estates Marbella SL will refund any money paid to us in full, and shall be under no further liability.. |
| 9. Our Responsibility for your Holiday |
| We accept responsibility for ensuring that all component parts of your holiday that you book with us are supplied to you as described by our staff and on our website. Any person booking accommodation with us does so entirely at their own risk and Exclusive Estates Marbella SL will not accept liability for the loss or damage to their personal property and possessions. Exclusive Estates Marbella SL can also not be held responsible for any building or maintenance works which are being carried out within your accommodation’s complex or the surrounding area. We will however do our best to inform you of any such works, offering the option of an alternative accommodation, if necessary, where possible. |

| If applicable, Exclusive Estates Marbella SL reserve the right to close the swimming pool and / or other facilities for periods of time for any valid reason and may do so without payment of any compensation or deduction from the rental price. |
| 10. Your Responsibilities |
| In the event that the maximum number allowed at the property being exceeded, without prior agreement by a member of Exclusive Marbella Estates SL staff, Exclusive Estates Marbella SL reserve the right to refuse or revoke the booking at their sole discretion. If any of the equipment or furnishings in the accommodation which you are occupying be lost or damaged, the client will be required to make an immediate cash settlement with Exclusive Estates Marbella SL on the owners´ behalf, for any necessary replacement or repair, either before or after your departure from the accommodation. Subletting any of our accommodations is strictly prohibited. |

| In the event that you lose the key to the rental property, or lock yourselves out, or have a similar client generated emergency, requiring a member of Exclusive Marbella Estates SL staff to be called to assist you, out of office hours, you will be responsible for an emergency call out charge. During office hours, there is no charge for this service (Monday – Friday 10am – 6pm and Saturday 10am – 2pm). However, from 7pm – 11pm the callout charge is 50 Euros and from 11pm – 10am, the call out charge is 80 Euros. You will also be responsible for any charges resulting from such an incident, such as a locksmith call out fee. |

| If you lose a set of keys, you will be charged a replacement fee. If a remote control for a car park is lost, there is an extra fee of 40 Euros to replace it. |
| 11. Car Hire |
| We have made arrangements with a reputable car hire company to provide pre-booked car hire at fully inclusive prices. We do not however, operate the car hire company, and only act as the reservation agent whether or not the car is included in an inclusive price. You must be satisfied with the rental conditions, insurance and condition of the car before taking delivery. |
| 12. Damage |
| Exclusive Estates Marbella SL shall not be held responsible for the death or personal injury of the client or any person named on the booking form, or any other person at the property. Exclusive Estates Marbella SL shall not be responsible for any loss, breach or delay due to any cause beyond their reasonable control (eg. Explosion, flood, fire or accident, war or threat of war, civil disturbance, governmental strikes, other industrial actions and adverse weather conditions). In any case such as this, we will treat the contract as discharged. In the event that the contract is discharged in any of these (or similar) situations, the liability of Exclusive Estates Marbella SL shall be to refund the sums paid to them in respect of the unused portion of the holiday calculated on a pro rata basis less an administrative charge of 20 Euros to cover reasonable expenses. |

| Exclusive Estates Marbella SL cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems etc, nor for failure of public utilities such as water, gas or electricity. Neither is Exclusive Estates Marbella SL responsible for noise or disturbance originating beyond the boundaries of the holiday accommodation, or which is out of their control. |
| 13. Behavior |
| The client signing the check in form will be liable for the correct and decent behavior of all the persons accompanying him/her. Should that person, or any of the persons accompanying him/her not behave in a suitable and responsible way, Exclusive Marbella shall be entitled to request the client and the persons accompanying him/her to leave the apartment without the right for the latter to claim any type of compensation. |

| Guests staying in an Exclusive Marbella apartment should know that if parties or loud music are heard, or neighbors complain and/or police are called, it can result in immediate eviction regardless of the time of day or night. This will also result in loss of prepaid rent and refundable damage deposit. Also note that by signing the booking form you are expected to abide by these rules. |
| 14. Cleaning |
| The apartment shall be cleaned prior to the arrival of each client. When leaving, the client is obliged to leave the apartment in a reasonable condition. Including removing all rubbish accumulated during your stay on departure and place them in the bins located on the perimeter of the complex. Our cleaners have a limited time to turn over the apartments for our next clients and would greatly appreciate your cooperation. |
| 15. If you are not happy with your accommodation |
| In the unlikely event of there being any problems with the property, the office must be informed immediately so that action can be taken to correct same. If you receive an answer phone response, please leave a short message and your telephone number and we will return your call ASAP or call the emergency numbers supplied. DO NOT wait until the end of your holiday to report any difficulties, as we will not accept responsibility for problems not reported when first encountered. |
